DACHNER vs. ROCCO: Motorcycle Supermoto Road Racing Lawsuit – Do Liability Waivers Even Matter?
Let’s talk about something very different today. Not the usual happy go lucky motorcycle stuff. This is serious business.
Rocco Landers, a young and up and coming motorcycle road racer is being sued by a family out of California. That’s according to Roadracing World, who published the press release written by Rocco’s lawyer.
You can check that article/press release out here. It includes a copy of the lawsuit referenced. I read the article out loud and go over some of my opinions on video here. You can check out the GoFundMe page to help Rocco by clicking here.
It needs to be said that I’m not a lawyer or legal professional of any kind. I’m just another motorcycle racer who knows how to read and feels offended by the fact this lawsuit even exists. It’s ridiculous.
To start with, Mr. Greg Dachner signed a liability waiver before he took to the track. To keep it going, he watched Rocco crash his bike twice and still decided it was safe to ride with Rocco. Rocco crashed into him, and here we are.
In my opinion, “OP” had every chance to inspect the track, see who was riding there, watch how they were riding, and then make an informed decision about how to ride and when based on what he had observed. He took to the track regardless, and here we are.
But again, I’m not a lawyer. I’m just a guy who can read and has opinions.
